Terms & Conditions

The Service is available to individuals of all ages and is not subject to a minimum age requirement, except where a minimum age is required by applicable law.
We do not knowingly restrict access to the Service based solely on a user's age. If you are a parent or legal guardian and believe that a child has provided personal information through the Service in a manner that you believe is inconsistent with applicable law or this Privacy Policy, please contact us. We will review the request and, where required by applicable law, take appropriate steps to address the information.
By using the Service you represent that you meet this requirement and that the information you provide (including the Receiver's information) is accurate and provided with the Receiver's knowledge and consent.

The Service allows a registered Sender to create a "time capsule" entry for New Year 2027 and to send an electronic gift ("E-Gift") to a Receiver. For the avoidance of doubt:

• All "gifts" referred to anywhere on the Service are electronic/digital gifts (E-Gifts) only, delivered solely via email to the address provided for the Receiver.
• No physical goods, merchandise, or items are shipped, delivered, or otherwise provided to any User or Receiver under any circumstance.
• Delivery of an E-Gift is dependent on the accuracy of the email address provided and on factors outside our control (e.g., spam filters, incorrect email addresses, Receiver email account issues).

To use the Service, a Sender must register and provide:

• Their own name, email address, and country; and
• The intended Receiver's name, email address, country and a message if they want to.

Registration requires password creation. You are responsible for maintaining the confidentiality of any credentials associated with your account and for all activity that occurs under it. You are solely responsible for the accuracy of both your own information and any information you submit about a Receiver, and for obtaining any consent required from the Receiver to share their information with us for the purpose of delivering the E-Gift.

• All fees must be paid in full before an E-Gift is processed and sent.
• All payments are final. Once payment is completed, the transaction, the E-Gift, and the order are non-refundable, non-cancellable, and non-editable — this includes, without limitation, changes to the Receiver's details, the gift content, the delivery date, or any request to reverse or cancel the transaction, in each case regardless of the reason (including Receiver error, Sender error, non-delivery due to an incorrect email address, or change of mind).
• No exceptions to the no-refund/no-cancellation/non-editable policy will be made except where required by mandatory law that cannot be waived (see Section 12).
• You are responsible for reviewing all order details (Receiver name, email, country, and gift content) before completing payment.

You agree that you will not use the Service to:

• Send an E-Gift or message to a person without that person's knowledge or an appropriate basis for contacting them;
• Harass, threaten, defraud, impersonate, or send unwanted, abusive, obscene, or unlawful content to any Receiver;
• Submit false, misleading, or another person's personal information without authorization; or
• Use the Service for any unlawful purpose or in violation of any applicable local, national, or international law, including export, sanctions, or anti-spam laws.

The Owner is not responsible for, and disclaims all liability arising from, any malpractice, misuse, harassment, unwanted gift, or unlawful conduct by a Sender toward a Receiver, or by any User of the Service. The Sender is solely and exclusively responsible for the content of any gift or message sent and for the decision to send it to a given Receiver. We reserve the right, but have no obligation, to suspend or terminate accounts that we believe, in our sole discretion, violate this Section.

All content on the Service, including its design, graphics, text, and software (excluding User-submitted content), is the property of New Year 2027 owner or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Service without our prior written consent.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any E-Gift will be successfully delivered or viewed by the intended Receiver.

To the maximum extent permitted by applicable law, New Year 2027 , its owner(s), officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or emotional distress, arising out of or in connection with your use of the Service, non-delivery or delayed delivery of an E-Gift, or the conduct of any Sender or Receiver — even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from the Service shall not exceed the amount you paid for the specific order giving rise to the claim.

You agree to indemnify and hold harmless New Year 2027 and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party, including a Receiver.

Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other Users, the Service, or third parties.

Nothing in these Terms limits any consumer protection right that applies to you and cannot be excluded or limited under the mandatory law of your country of residence (for example, statutory withdrawal rights for digital content in certain jurisdictions). Where such a mandatory right applies, it will apply to the extent required by that law, notwithstanding Section 4.

The Platform provides users with the ability to purchase and send digital gifts through the services made available on the Website. The Platform currently offers two fixed-price gift options:

Standard Gift: $0.27 USD
Premium Gift: $20.27 USD

The exact features, contents, appearance, availability, and delivery method of a gift may vary depending on the gift selected and the functionality available on the Platform.
Our prices are intentionally based on a simplified fixed conversion of:
1 USD = ₹100 INR
This is a pricing convention used by the Platform and is not intended to represent the actual market exchange rate. Accordingly:

Standard Gift: $0.27 = ₹27
Premium Gift: $20.27 = ₹2,027

The Platform may use these fixed amounts for pricing and display purposes even when the actual USD/INR exchange rate is different. The fixed pricing system is part of the Platform's pricing structure and is designed around the Platform's 2027-themed pricing concept and operational model.

We may update these Terms from time to time. Material changes will be indicated by updating the "Last Updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
